The Role of the Zoning Board of Appeals
The zoning board of appeals (ZBA) consists of five members and an
alternate who are appointed by the board of trustees. The planning
commission and the township board each have a representative that
serves as a liaison to the ZBA. Members are appointed to three year
terms.
The ZBA is a semi-judicial body which is established to hear and
act on the following matters: appeal of an administrative decision,
variance from the standards contained in the zoning ordinance, sign
variances, use variances and zoning ordinance interpretations.
The most common requests are variances from requirements contained
in the zoning ordinance, such as setbacks. In order for a variance to
be considered, the applicant must demonstrate the following conditions
are met. These conditions are summarized below, the entire set of
criteria are contained within the application form which is available
from our publications download page.
- An exceptional or extraordinary condition exists and compliance
with township standards would render conformity unnecessarily
burdensome.
- The practical difficulty is unique to the site and different
than other properties in the same zoning district or vicinity.
- The situation shall not be self-created.
- The request would provide substantial justice by preserving
property rights similar to the majority of other properties in the
same zoning district or vicinity.
- The variance is the minimum necessary to grant relief from the
practical difficulty.
- The request complies with other state and federal laws.
